Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Advariant, you agree to comply with these Terms of Service and the related policies. If you do not agree to these Terms, do not use the Service.

If you use the Service on behalf of a company or other organization, you represent that you have the authority to accept these Terms on its behalf.

2. Description of the Service

Advariant provides an AI-powered creative workflow built around reference advertisements, including transcription, creative analysis, script generation, video generation, and asset management. The availability of features may change as the product develops.

3. Eligibility and Account Responsibility

You must be at least 18 years old or have reached the legal age to enter into a contract in your jurisdiction, and you must have the legal capacity to accept these Terms.

You must provide accurate account information and are responsible for activity conducted through your account. You must take reasonable steps to protect your account and login credentials and notify us promptly if you become aware of unauthorized use.

4. Subscriptions, Credits, and Payments

Advariant offers a 7-day free trial. The free trial does not automatically create a paid subscription or result in subscription charges. You must actively select a plan and complete payment before entering a paid subscription.

Paid subscriptions automatically renew according to the billing cycle you select until canceled. You may cancel before your next billing date, and the cancellation will take effect at the end of your current paid billing period.

Plan prices, credit allocations, credit usage, content retention periods, and other benefits are as displayed on the pricing or checkout page. Subscription plan credits are issued for the applicable subscription cycle and expire at the end of that cycle. The purchase and use of credit add-ons are subject to the conditions displayed in the product.

By completing a payment, you authorize the applicable charge. Payments are processed by Stripe, a third-party payment service provider, and are subject to Stripe's applicable terms.

If an automatic renewal payment fails, we may suspend the applicable subscription benefits until payment succeeds or the subscription is canceled.

5. Cancellation and Refunds

You may cancel your subscription before the next billing date. Cancellation takes effect at the end of the current paid billing period, and you may continue using the applicable plan benefits until that time.

Canceling a subscription does not automatically entitle you to a refund. Refund requests and eligibility are governed by our published Refund and Cancellation Policy.

6. User Content and AI-Generated Content

You retain the rights you hold in content that you upload, submit, or enter. You grant Advariant a limited license to store, reproduce, transmit, analyze, and process such content to the extent necessary to provide the Service.

You must ensure that you have all rights and permissions necessary for content that you upload, submit, or enter and that the content does not infringe any third party's intellectual property, privacy, publicity, image, voice, or other legal rights.

To the extent permitted by applicable law, you may use content generated through the Service. AI-generated content may be inaccurate, non-unique, or similar to third-party content. Advariant does not guarantee that generated content is eligible for copyright protection, is exclusive, or is suitable for a particular commercial purpose.

You are responsible for reviewing the accuracy, legality, suitability, and platform compliance of generated content before publishing, advertising, or otherwise using it commercially.

7. Advariant Intellectual Property

All rights in the Advariant Service, software, interfaces, branding, trademarks, related technology, and content belong to NEUXMIND (SINGAPORE) PTE. LTD. or the applicable rights holders.

Unless authorized, you may not copy, sell, rent, modify, reverse engineer, or otherwise exploit the Advariant Service, software, or related technology, except where expressly permitted by applicable law.

8. Prohibited Conduct and Account Actions

You may not:

• Upload, generate, or distribute unlawful, infringing, malicious, fraudulent, or unauthorized content;
• Use another person's image, voice, identity, trademark, or other protected content without the necessary authorization;
• Use the Service to commit fraud, mislead others, impersonate another person, or violate the legal rights of others;
• Attempt to damage, bypass, abuse, or interfere with the Service, security measures, credit system, or access restrictions;
• Upload malicious code or access another user's account, data, or systems without authorization.

If you violate these Terms, engage in fraud or abuse, infringe third-party rights, initiate abusive chargebacks, or otherwise create risks to the security or compliance of the Service, Advariant may restrict, suspend, or terminate your account or access to the Service.

9. Service Availability and Changes

We may update, suspend, restrict, or discontinue certain features to maintain security, stability, and compliance or to support product development. We will use reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation.

10. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. You are responsible for evaluating the accuracy, suitability, and compliance of AI outputs, advertising content, and campaign materials.

Advariant is not liable, to the extent permitted by applicable law, for indirect or consequential losses, loss of profits, loss of data, business interruption, or other indirect consequences arising from use of the Service.

To the extent permitted by applicable law, Advariant's aggregate liability in connection with the Service will not exceed the amount you actually paid to Advariant during the 12 months preceding the event giving rise to the relevant claim. These limitations do not apply to liabilities that cannot be limited or excluded under applicable law.

11. Changes to These Terms

We may update these Terms to reflect changes to product features, legal requirements, or the way the Service is provided. Updated Terms will be published on this page and will take effect on the date displayed on the page.

If we make material changes, we may notify users through the product, account notifications, or other reasonable means. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore. Any dispute arising from or relating to the Service or these Terms will be subject to the jurisdiction of the courts of Singapore.
